1. About these terms
This website is published by Dr. Timothy Arrowsmith as a personal academic site. By using it, you accept these terms. If you do not accept them, please do not use the site.
I may revise these terms from time to time. The version published here is the one that applies.
2. The nature of the content
Everything here is published for information, research and discussion. Posts summarise legislation, statistics and academic work, and offer commentary and argument on them.
Nothing on this site is legal advice, medical advice, financial advice or professional safety advice, and nothing here creates a professional relationship of any kind between us. Statutes, regulations and official statistics are summarised in good faith and with sources given, but they change, they vary between jurisdictions, and summaries are not substitutes for the source. If you are making a decision that matters — about your own riding, your equipment, your compliance obligations or anything else — consult the primary source and, where appropriate, a suitably qualified professional.
Opinions expressed are my own and not those of any institution with which I am or have been associated.
3. Accuracy
I take reasonable care to be accurate, cite sources and correct mistakes when they are pointed out. I do not warrant that the content is complete, current or error-free. Where a figure or a legal position is disputed, I try to say so.
If you find an error, please tell me. I would rather fix it than defend it.
4. Intellectual property
The written content of this site is my own work and is protected by copyright.
You may quote from it for the purposes of research, private study, criticism, review, teaching or news reporting, provided you attribute it to me and link to the original page. That permission is deliberate — this is academic writing and it is meant to be cited.
You may not republish substantial portions or entire posts elsewhere, whether on a website, in a publication or as training material for a commercial product, without my written permission. Ask; I am not unreasonable.
Third-party material reproduced or linked here — images, quotations, data — remains the property of its owners.
5. Comments and contributions
If you leave a comment, you keep ownership of what you wrote. By submitting it you grant me a non-exclusive, royalty-free licence to display, store and moderate it on this site.
You are responsible for what you post, and you confirm that it is your own work or that you have the right to post it, and that it is not unlawful, defamatory or infringing.
Comments are moderated. I may edit, decline or remove any comment, at my discretion and without giving reasons — though in practice I will usually say why. See the Terms of Use for what is and is not welcome.
6. Links to other sites
This site links extensively to legislation, government publications, journals and news reports. Those sites are not under my control. A link is a citation, not an endorsement, and I am not responsible for their content or their privacy practices.
7. Availability
I make no promise that the site will be available uninterrupted or error-free. I may change, suspend or withdraw any part of it at any time.
8. Liability
To the fullest extent permitted by law, I am not liable for any loss or damage arising from your use of this site or reliance on its content, including indirect or consequential loss.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
9. Indemnity
You agree to indemnify me against any claim arising from your breach of these terms or from material you submit to the site.
10. Governing law
These terms are governed by the laws of the State of California, and the courts of California will have jurisdiction over any dispute — save that if you are a consumer resident elsewhere, you may have the benefit of mandatory protections under the law of your own country, and nothing here removes them.
